Welcome to Surkhave. These Terms & Conditions explain how our virtual school and LMS work and what we expect from users. We keep the language short and practical — please read it. By using the site you accept these terms and our Privacy Policy. If you disagree, please do not use Surkhave.

Definitions

“Surkhave”, “we”, “us” refers to the platform operator. “You”, “user” or “learner” means any person using the platform. “Content” means lessons, recordings, quizzes and materials uploaded by tutors or the platform. “Tutor” means a teacher or content creator who provides lessons on Surkhave.

These definitions help keep the terms clear and reduce ambiguity in how they are applied across accounts, courses and community features.

1. Using Surkhave

By using Surkhave you agree to these Terms and our Privacy Policy. Access to parts of the platform may require registration. Use the services lawfully, honestly and with respect for other users. If we detect misuse or a serious breach, we may restrict access while we investigate.

We reserve the right to limit features, modify or remove services for operational reasons. Where possible we will provide notice before major changes that materially affect learners’ access to paid content.

2. Accounts

Some parts of the platform require an account. Provide accurate information, choose a secure password, and keep contact details current. You are responsible for all activity on your account. If you suspect unauthorised access, notify us immediately via Contact.

Accounts for minors may require parental consent; parents can manage or request data for child accounts as set out in our Privacy Policy. Account sharing is discouraged; if your access credentials are shared, you accept responsibility for any consequences.

3. Behaviour

Be respectful. Don’t harass others, share illegal material, or try to break the site. Disruptive or abusive behaviour may result in warnings, temporary suspension, or permanent account removal. We expect learners and tutors to uphold a safe, constructive atmosphere in live classes and forums.

We use a staged approach to enforcement: warning, temporary limits, and suspension for repeated offences, except in serious breaches where immediate removal may occur. Appeals can be sent to Contact and will be reviewed fairly.

4. Course Content

Teachers and creators retain ownership of the content they upload unless agreed otherwise. By uploading content you grant Surkhave a non-exclusive licence to host and display it to learners. Do not download, repost, redistribute or sell content from Surkhave without explicit permission from the content owner.

We may remove content that breaches our guidelines or applicable law. If you believe your content has been used without permission, contact us and we will follow an appropriate takedown and review process.

5. Payments & Refunds

Certain classes or features may require payment. Fees are displayed at checkout and charged via our payment partners whose terms also apply. Refunds are processed according to our Refund Policy; request refunds via Contact within the stated window.

In borderline cases we aim for fair outcomes: exchanges, credit notes, or rescheduled sessions. Refunds may be withheld if misuse or breach of terms is found. We are pragmatic: our goal is to ensure learners get value, and to resolve issues simply and directly.

6. Privacy

We collect data to run the LMS and improve learning. Our Privacy Policy explains what we collect, how we use it, and your rights. Using Surkhave means you accept those practices. We strive to keep data secure and to limit access to authorised staff and tutors only.

Intellectual Property

All platform branding, interface design and core materials provided by Surkhave are our intellectual property. You may not use our logos, trademarks or design elements without written permission. Tutors keep ownership of their teaching materials but grant us licence to operate the service.

7. Limits on Liability

We work to provide a safe and reliable service, but Surkhave is not liable for indirect, incidental or special damages. Our total liability to you for direct losses is limited to the fees you paid in the twelve months prior to the claim, or a nominal statutory amount where applicable. Nothing in these terms excludes liability for death or personal injury caused by our negligence or for other liabilities that cannot be excluded by law.

This limit is a balanced approach: it protects users while keeping the platform viable to serve many learners fairly.

8. Ending Access

We may suspend or close accounts for breaches, inactivity, or legal reasons. If access ends, any licence you had to use paid content terminates. You may request data export before closure where feasible and permitted by law; see our Privacy Policy for details.

Where closures are for reasons beyond your control we aim to give notice and options such as refunds or transfer credits when practical.

Accessibility & Support

We aim to make Surkhave accessible: transcripts for videos, keyboard navigation and clear headings. If you need help using the platform for accessibility reasons, contact support and we will assist with reasonable accommodations.

For technical support, billing questions, or scheduling help, contact our team via Contact and we’ll respond as quickly as possible.

Force Majeure

We are not liable for failure to perform due to events outside our reasonable control (for example, natural disasters, strikes, network outages). Where possible we will communicate disruptions and attempt reasonable workarounds.

9. Law & Disputes

These Terms are governed by the laws of Pakistan. If disputes arise, courts in Pakistan normally have jurisdiction unless both parties agree otherwise in writing. We encourage users to contact us via Contact to resolve issues informally before escalating.

10. Updates

We may update these Terms from time to time. Material changes will be posted on the site and, where appropriate, notified by email. Continued use of Surkhave after updates indicates acceptance of the revised terms. We recommend reviewing this page periodically.

Example: How disputes or refunds are handled

Mini-case (anonymized): A student purchased a mock test but experienced technical issues that prevented completion. They contacted support within 48 hours; we verified the issue and offered a resit or refund according to policy. This illustrates our practical, user-friendly approach to resolving problems.

Another example: a tutor posted material that inadvertently duplicated copyrighted content. After a takedown request and quick verification, the material was removed and the tutor was guided on submitting original content. We aim to resolve issues fairly and with transparency.
